John Wieland Homes - Misleading statements and negligence, at Paces Walk, Smyrna
We puchased a townhome in Paces Walk, Smyrna. It was advertised as a John Weiland Development. Indeed, all meetings were conducted at the John Weiland Headquarters on Atlanta Road, which is across the street from Paces Walk, a 19-unit townhome development. Later, we learned that the developer was Chatahoochie Enterprises of which Mr. Wieland is a major officer.
At closing, we were required to pay 3 months of the monthly association fee which we were informed would be placed in a capital reserve account.
Recently, we learned from the owner of the the company retained by Chatahoochie to maintain the common areas, he had determined in 2014 that the sprinkler system for the common areas of development was broken. He reported this fact to Chatahoochie and was informed to "turn it off and not do anything about it." Of course, during this hot summer, residents started to notice things turning brown from lack of water
The developer turned the community over to the owners' association in June of 2015. We then learned that there was no capital reserve account as we had been led to believe was created. The sprinkler issue has yet to be resolved.
